March 2, 2010-We won our 4 year battle for our Payroll employees. History of Payroll Arbitration: Met Council took our payroll department and combined it with another in St Paul in 2006. We grieved this action and----- ATU Local 1005 wins payroll arbitration ! We received the arbitration answer and it states the grievance is sustained and that all payroll duties are to be restored to the ATU bargaining unit. Update #1: The Metropolitan Council has decided not to honor the payroll arbitration award. They have chosen to file papers in court to overturn the neutral arbitrators award. We clearly are not dealing with honorable people. This act of defiance certainly opens a new era in our relationship. So stay tuned we will update you as things progress.New Page 2 Update #2: ATU 1005 and AFSCME 668 met with the Metropolitan Council on Tuesday morning 6/10/08 in an effort to resolve the payroll situation. We were unable to reach any agreements. No further meetings have been scheduled. Update #3: This case has now been turned over to our attorney and will proceed to court. Update #4: Dated April 15th, 2009, Metro Transit was GRANTED the motion to Vacate the Arbitration Award. An arbitration award may be vacated based on one of the statutory grounds set forth in MN statutes 572.19, Subd.1. The judge ruled that the arbitrator improperly exceeded his powers and that his decision is invalid and shall be vacated. We are appealing this decision Update #5: In August of 2009 we filed our appeal. UPDATE #6: March 2, 2010 We won in the Court of Appeals! Update #7: April 19th, 2010 ..........Still waiting for the Met Council to honor the award.... Update #8: May 14th, 2010..........met with Payroll managers and BMS (Bureau of Mediation Services). We began negotiating transition back.
